Introduction

Welcome to NexusDialer. By accessing or using this application, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before use.

License

Ingenious Digital LLC grants you a personal, non-exclusive, non-transferable license to use NexusDialer for business purposes within your organization. You may not:

• Copy, modify, or distribute the application
• Reverse engineer or attempt to extract the source code
• Sublicense or sell access to the application
• Use the application for any unlawful purpose

Account & Access

Access to NexusDialer requires an account provisioned by your organization's administrator. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying your administrator immediately of any unauthorized access

Acceptable Use

NexusDialer is an enterprise contact center platform. You agree to use it only for lawful business communications. You must:

• Comply with all applicable telemarketing and communication laws
• Obtain proper consent before contacting individuals
• Honor Do Not Call (DNC) lists and opt-out requests
• Not use the platform for spam, harassment, or unsolicited contact

Telecom & Compliance

NexusDialer supports Bring Your Own SIP (BYOS). You are solely responsible for compliance with applicable laws, including but not limited to:

• TCPA — Telephone Consumer Protection Act (US)
• TSR — Telemarketing Sales Rule (FTC)
• GDPR — General Data Protection Regulation (EU)
• CCPA — California Consumer Privacy Act

NexusDialer provides tools for managing outreach — compliance with the laws governing that outreach is your responsibility.

SIP & Telephony

When using BYOS, you are responsible for your SIP trunk provider's terms and any per-minute or usage-based charges they impose. Ingenious Digital LLC is not a telecommunications carrier and does not provide phone service directly.

Data & Privacy

NexusDialer processes call data, contact information, and campaign records within your organization's instance. See our Privacy Policy for full details on data collection and handling.

Disclaimer of Warranties

NexusDialer is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted service, call quality, or specific connection rates.

Limitation of Liability

To the fullest extent permitted by law, Ingenious Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of NexusDialer, including loss of data, profits, business opportunities, or damages arising from regulatory non-compliance.

Termination

Your organization's administrator may terminate your access at any time. We reserve the right to suspend or terminate accounts that violate these terms or applicable law.

Changes to These Terms

We reserve the right to modify these terms at any time. Continued use of the application after changes are posted constitutes acceptance of the revised terms. We will make reasonable efforts to notify organization administrators of material changes.

Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
